TERMS OF SERVICE

These terms apply to your use of the Horologia Bella Luxury Watches website and to purchases made from us.

By using this website or placing an order, you agree to these terms. Nothing in these terms limits your statutory rights as a consumer.

Viewings and collections are available by confirmed appointment only in West Sussex and London.

  1. OUR WATCHES

We sell new, unworn, pre-owned and vintage watches. Each listing will describe the watch’s age, condition, accessories, box, papers, warranty status and other relevant information to the best of our knowledge.

Unless clearly identified otherwise, product photographs show the actual watch offered for sale.

Pre-owned and vintage watches may display signs of age, previous wear, polishing, servicing or component replacement. These characteristics will be described where known and reasonably identifiable.

Condition assessments are opinions based on our inspection and are intended to help customers make an informed decision. Customers should review all photographs and descriptions and contact us with any questions before purchasing.

  1. AUTHENTICITY AND OWNERSHIP

Every watch is inspected and checked before being offered for sale. We guarantee that watches sold by Horologia Bella Luxury Watches are authentic unless a listing expressly identifies a component or accessory as aftermarket.

We confirm that we have the right to sell each watch and that, to the best of our knowledge and after appropriate checks, it is free from undisclosed finance, theft reports or third-party ownership claims.

Serial numbers may be recorded and partially obscured in public photographs for security purposes.

  1. AVAILABILITY

Most watches offered are individual items and only one is available.

A watch may also be advertised through other sales channels. Adding a watch to your basket does not reserve it.

If a watch is sold elsewhere before we can process your order, we will cancel the order and refund any payment received in full.

  1. ORDERS AND CONTRACT FORMATION

Submitting an order constitutes an offer to purchase the watch.

An automated order acknowledgement confirms that we have received your order but does not necessarily confirm acceptance.

We may review the order, payment, customer information, delivery address and fraud-analysis results before accepting it.

A binding sales contract is formed when we confirm acceptance of the order or dispatch the watch, whichever occurs first.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

• the watch is no longer available;
• payment has not been authorised or received;
• customer or delivery information cannot be verified;
• fraud or security concerns arise;
• an obvious pricing or listing error has occurred; or
• fulfilling the order would breach a legal or regulatory requirement.

If payment has already been taken for an order we cannot accept, it will be refunded.

  1. PRICES AND PAYMENT

All prices are displayed in pounds sterling.

Prices include any taxes legally required to be included at the time of sale. Delivery charges, where applicable, will be shown before checkout.

We accept the payment methods displayed at checkout.

Card payments may initially be authorised and then manually captured after the order has passed our security review. An authorisation may appear as a pending transaction with your bank before payment is captured.

Bank-transfer orders remain unpaid and are not confirmed for dispatch until cleared funds have been received and verified.

The customer is responsible for ensuring that payment is made from a legitimate source and that they are authorised to use the selected payment method.

  1. PRICING AND LISTING ERRORS

We take reasonable care to ensure that prices and descriptions are accurate.

If an obvious pricing, specification or listing error is discovered before dispatch, we may cancel the order and issue a full refund. We will contact you where appropriate and may offer the opportunity to purchase at the correct price.

  1. SECURITY AND FRAUD PREVENTION

Due to the value and nature of the products we sell, orders may be subject to additional security checks.

We may request reasonable information needed to verify the buyer, payment method or delivery address. We will handle personal information in accordance with our Privacy Policy.

We may restrict delivery to an address approved through our payment and fraud-prevention checks.

  1. DELIVERY

We currently deliver within the United Kingdom only.

Delivery terms, timescales and restrictions are explained in our Shipping Policy, which forms part of these terms.

Ownership does not pass until payment has been received in full. Responsibility for the watch passes in accordance with applicable consumer law and our Shipping Policy.

  1. CANCELLATIONS, RETURNS AND REFUNDS

Consumer cancellation and return rights are explained in our Return and Refund Policy, which forms part of these terms.

Nothing in these terms removes or restricts rights provided by the Consumer Contracts Regulations 2013 or Consumer Rights Act 2015.

  1. CONDITION, ACCURACY AND WATER RESISTANCE

Mechanical watches can vary in accuracy depending on movement type, age, position, temperature, power reserve and wearing habits. Any timing result supplied represents performance during testing and is not a guarantee of identical performance in every circumstance.

Water resistance is not permanent and may deteriorate through age, wear, accidental impact or deterioration of seals.

Unless a current pressure test or specific water-resistance assurance is expressly included in the listing, customers should not assume that a pre-owned or vintage watch remains water resistant. We recommend periodic testing before exposure to water.

  1. WARRANTIES AND SERVICING

Any remaining manufacturer’s warranty, dealer warranty or service warranty supplied with a watch will be identified in the product listing or sales documentation.

A manufacturer’s warranty is subject to the manufacturer’s own terms and eligibility requirements.

Unless expressly stated, a pre-owned watch is not represented as having a current manufacturer’s warranty.

No commercial warranty excludes or replaces your statutory consumer rights.

Damage caused by misuse, impact, water ingress contrary to stated resistance, unauthorised alteration or repairs by an unrelated third party may not be covered by a commercial warranty. Statutory rights remain unaffected.

  1. BOXES, PAPERS AND ACCESSORIES

The items included with each watch are listed in its description.

A “full set” generally refers to the box and papers or warranty documentation ordinarily supplied with the watch, together with any additional items specifically identified in the listing. The precise contents can vary by brand, model, age and country of original sale.

Presentation boxes and accessories may display age-related deterioration even where the watch itself is in excellent condition.

  1. PART EXCHANGE, SELLING AND SOURCING

Any purchase by us, part-exchange transaction, consignment arrangement or sourcing service may be subject to separate written terms, valuation, authentication, inspection and ownership checks.

An indicative valuation is not binding until the watch has been physically inspected and final terms have been agreed.

  1. WEBSITE USE

You may use this website only for lawful personal or business purposes.

Website content, branding, photographs, descriptions and other material belonging to Horologia Bella Luxury Watches must not be copied, reproduced or used commercially without prior written permission.

You must not attempt to interfere with the website, misuse its checkout, introduce malicious code or use false information when placing an order.

  1. THIRD-PARTY SERVICES

The website may use or link to third-party services, including payment providers, delivery companies and social-media platforms.

We are not responsible for third-party websites or services outside our reasonable control, although this does not affect our responsibility for fulfilling a contract made directly with you.

  1. LIABILITY

Nothing in these terms excludes liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or breach of statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

If you are purchasing wholly or mainly for business or resale purposes, our total liability relating to the transaction will not exceed the amount paid for the relevant watch, except where liability cannot legally be limited.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by events outside our reasonable control, including courier disruption, severe weather, industrial action, failure of communications networks or government restrictions.

We will take reasonable steps to minimise disruption and keep affected customers informed.

  1. CHANGES TO THESE TERMS

We may update these terms periodically. The terms applying to a purchase are those in force when the order is placed.

  1. GOVERNING LAW

These terms are governed by the laws of England and Wales.

Consumers living elsewhere in the United Kingdom retain any mandatory protections provided by the laws applicable to them.
